The effect of tourism and legalization policies on summer pasture in Turkey

    Döner, Fatih

In Turkey, according to Pasture Law, land allocated for farmers to spend the summer with their animals, graze their animals and benefit from grass is defined as “summer pasture (yaylak in Turkish).” Summer pasture is of national importance for its biodiversity, landscape, cultural heritage and transhumance. However, especially after 1990s, the summer pasture areas have been extensively used in tourism activities in Turkey. By changing land use, the increasing tourism activities combined with legal uncertainties and the legalization policies have caused summer pasture areas transferred into built-up areas. The effect of the tourism and legalization policies on the land use changes in summer pasture areas was evaluated in this study. It was determined that Turkey's tourism and legalization policies have adverse effect on sustainable use of summer pasture areas. These policies aimed at economic development and solving property problems of rural areas caused new legal problems and expansion of built-up areas. A better land use policy and an effective control mechanism are necessary for the sustainable use of summer pasture areas.

Evaluation of the process for acquisition of land property in the implementation of power transmission line projects

    Döner, Fatih; Kaya, Erhan

While preparing PTL (Power Transmission Line) projects, the land where the PTL is crossing is determined by considering criteria such as economy, environment and security. The realization of PTL projects is possible after acquisition of property of these lands. In this study, the process of acquisition land property in the implementation of PTL projects is evaluated. When data are examined, it is seen that the number of lawsuits filed against the PTL in past year was 15759 and rate of non-court settlement with land owners in the five-year period was 13%. The main factor for the high number of lawsuits and low settlement rate is real estate valuation studies in determining the price to be paid for land to which the PTL will be established. As land value determined as a result of valuation methods, criteria and rates referenced does not reflect real value in most cases, no agreement can be reached with the land owners. It is considered that most ideal solution from a legal point of view is to prepare a holistic valuation law that regulates real estate valuation activities, from an organizational point of view is to set a connection between cadastre and real estate valuation and from a technical point of view is to set-up a database which enables managing properties of real estates and their up-to-date values.

Analysis of literature on 3D cadastre

    Döner, Fatih

In this study, it is aimed to analyse the three-dimensional (3D) cadastre literature in terms of legal, institutional, and technical aspects. For this purpose, 441 publications published between 2001 and 2019 were examined. In the literature, which includes publications from 59 different countries the studies mostly focused on technical issues. An international consensus on legal, institutional, and technical aspects of a 3D cadastre solution seems difficult. Since rights, restrictions, and responsibilities with a 3D component are somehow registered administratively, stakeholders from the legal domain are reluctant to 3D cadastre. From a technical point of view, the technology required to use 3D digital data for registration has matured sufficiently in the past twenty years. However, further research on a real 3D cadastre solution, creating a workflow that considers both current legal and technical framework beyond pilot studies, is needed.

3D digital representation of cadastral data in Turkey-Apartments case

    Döner, Fatih; Şirin, Samet

With the widespread use of three-dimensional (3D) geographic information technologies, studies for 3D digital representation of property units in cadasters have increased in recent years. In Turkey, a project named 3D City Models and Cadasters was initiated by the General Directorate of Land Registries and Cadasters in 2018. With this project, which is planned to last four years, it aims to create 3D models of individual units (apartments) in buildings and provide visual representations of these individual units with legal information. Transition from the current 2D representation towards a 3D digital cadaster requires not only replacing analog drawings with 3D models but also examining the workflow for forming the property units. In this study, the process of registration of property rights for individual units is examined and possibilities and challenges for successful completion of the 3D cadaster project are evaluated from a legal, an organizational, and a technical point of view. Government plays a lead role by adopting the digital transformation as a state policy. However, new regulations and organizational settings may have to be introduced. Modeling and visualization alternatives for 3D data should be studied further.

Solutions for 4D cadastre - with a case study on utility networks

Döner, Fatih; Thompson, Rod; Stoter, Jantien; Lemmen, Christiaan; Ploeger, Hendrik; van Oosterom, Peter; Zlatanova, Sisi

The increasing complexity and flexibility of modern land use requires that cadastres need to manage information on the third and temporal (fourth) dimension. This article considers the registration of legal space of utility networks in cadastre in this 3D + time (=4D) context. A requirement analysis in three countries that have methods to register utility networks complying with their legal, organizational and technical structure (Turkey, the Netherlands and Queensland, Australia) is the basis for three alternatives for 4D cadastre to register utility networks. The three alternatives are analysed with respect to legal, organizational and technical cadastral requirements. This article presents a case study and a prototype from the Netherlands. In this country by law utilities are considered to be real estate objects with obligatory registration of ownership and geometry. This study shows that the 3D space and separate temporal attributes approach (state-based model) is a very promising solution to maintain temporal changes of utility networks and that this approach is to be preferred above the current practice, where the 3D and temporal aspects are not considered when registering a network.

Using landsat data to determine land use/land cover changes in gümüşhane, Turkey

    Döner, Fatih

Sustainable land use and development require timely, accurate and detailed information of land resources as well as changes in the land resource. 'What is changing in where' question is answered by multiple observations over a period of time. Remote sensing technology provides such a monitoring requirement. The aim of this study was to analyze land use/ land cover (LU/LC) changes between 1975 and 2000 in Gümüs ̧hane, Turkey, using satellite images. Three Landsat images from 1975, 1987 and 2000 were used to determine changes. A post classification technique was used based on a hybrid classification approach (unsupervised and supervised). Images were classified into five LU/LC types; urban, agriculture, forest, pasture and other lands. It is found that significant changes in land cover occurred between the years 1975 and 2000. The results showed an increase in urban, forest and agriculture and a decrease in pasture and other lands between 1975 and 2000. In this period, urban land increased from 1.25 to 3.78% of the total area. While the area of pasture decreased from 26.74 to 23.44% of the total area, the area of forest and agriculture increased from 37.32 to 39.51% and from 8.83 to 13.27%, respectively.

4D cadastres: First analysis of legal, organizational, and technical impact-With a case study on utility networks

Döner, Fatih; Thompson, Rod; Stoter, Jantien; Lemmen, Christiaan; Ploeger, Hendrik; van Oosterom, Peter; Zlatanova, Sisi

The increasing complexity and flexibility of modern land use requires that cadastres need an improved capacity to manage the third dimension. As the world is per definition not static, there also will be needs in relation to the representation of the temporal (fourth) dimension either integrated with the spatial dimensions or as separate attribute(s). In this paper, registration of utility networks in cadastre are considered in this 3D. +. time (=4D) context. A number of countries in the world have developed methods to register utility networks complying with their legal, organizational, and technical structure. We researched the different approaches of three specific countries: Turkey, The Netherlands and Queensland, Australia. These are analysed to evaluate a solution that matches legal, organizational, and technical cadastral requirements in the most optimal way.

Examination and comparison of Mobile GIS technology for real time geo-data acquisition in the field

    Döner, Fatih; Yomralioǧlu, T.

Scientific studies associated with land require large amount of data. The data is often collected during field studies with the use of pencil and paper based method. The method is labour-intensive and susceptible to recording and georeferencing errors during transcription. Recent advances in mobile computing, positioning and software now make it possible to bring field and office activities into a collaborative environment, thereby minimizing human errors and time delays. This paper assesses the use of Mobile Geographic Information Systems (MGIS) as an appropriate tool for geo-data acquisition applications. Firstly the computing, positioning, software and communication technology behind the system is presented. A Mobile Geographic Information System developed for field data acquisition based on the combination of Geographic Information Systems (GIS) and Global Positioning System (GPS) is described. Finally, the system is tested in two field studies to examine its effectiveness compared to traditional methods in terms of accuracy, cost and project completion time. The field studies demonstrate the noticeable gains in efficiency and cost saving achieved with the use of the MGIS technology, Results of the field studies verify that MGIS is very useful for georeferenced data acquisition applications.
