"Hadislerle İslam" adlı eserde aile hakkındaki hadislere getirilen yorumların fıkhî açıdan değerlendirilmesi

Tezin ana konusunu Diyanet İşleri Başkanlığı tarafından kurulan komisyon üyelerince telif edilen Hadislerle İslam eserinde âile hukuku açısından ahkâm hadislerinin değerlendirilmesi oluşturmaktadır. Bu yüzden çalışmada âile hukuku ile ilgili konulara genel manada yer verilmiştir. Ardından Hadislerle İslam'da zikredilen âile hukuku ile ilgili hadislere dair yorumlar, tahliller ve tercihler incelenmiştir. Komisyonun ortaya koymuş olduğu tercihler hangi hadislere dayanmaktadır bu husus tespit edilmeye çalışılmıştır. Bu çalışma iki bölümden oluşmaktadır. İlk bölümde genel anlamda âile hukukunun neyi ifade ettiği konu edilmiştir. Sonrasında evlilik öncesi evreler yani kız isteme, nişanlanma vb. konular işlenmiştir. Ayrıca nikâh ve nikâhla ilintili hususlar ele alınmıştır. İlgili bölümde evlilik çeşitlerine, kadının nikâh akdiyle hak ettiği mehre ve nafakaya, nikâhın hükmüne ve kaç kişiyle evlenilebileceğine değinilmiştir. The main subject of the thesis is the evaluation of the hadiths in terms of family law in the Islamic work with the Hadiths compiled by the members of the commission established by the Presidency of Religious Affairs. Therefore, in the study, issues related to family law are given in general terms. Then, the interpretations, analyzes and preferences of the hadiths related to family law mentioned in the Hadislerle İslam were examined. It has been tried to determine which hadiths the preferences put forward by the commission are based on. This study consists of two parts. In the first part, what the family law means in general is discussed. Afterwards, the pre-marriage phases that is, asking for a girl, getting engaged, etc. topics are covered. In addition, marriage and related issues are discussed. In the relevant section, the types of marriage, the dowry and alimony that the woman deserves with the marriage contract, the provision of the marriage and how many people can be married are mentioned.
