Telkenaroğlu, M. Rahmi

Moreover, it orders them to be performed by a sufficient number of Muslim people. The scholars of Islamic law have not found the material element of thegeneral theory of crime that preconditions to inflict punishment on the crimesof manslaughter and actual bodily harm adequate, yet they have also paidattention to whether there are other grounds of justification. One of the factors that removes the criminal responsibility of actual bodily harm when there is no use of violence against rival in sporting activities has been adopted legally by Islamic law, is called “the use of right”. However, the factor that removes this kind of responsibility in the combat sports, which is performed on the rival’s body, is due to a permission taken by the approval of the persons.
